In line with a series of regulatory initiatives by the European Securities and Markets Authority (ESMA), Cyprus—the “forex brokerage kingdom” located in the eastern Mediterranean—has followed suit, and its financial legislation has also drawn significant attention. The Cyprus Securities and Exchange Commission (CySEC) has introduced a series of innovative measures to protect retail clients and brokers trading with Cypriot financial institutions.
As a forex broker or retail client, you may feel overwhelmed trying to keep up with all the financial regulatory news from the past three to five years. Of course, all these measures are well-intentioned, with the primary goal of protecting investors and member firms from bankruptcy. However, increasing regulatory pressure can sometimes lead to the opposite result—a decline in market liquidity that harms retail trading.
For this reason, Cypriot policymakers have decided to adopt a more flexible approach to their leverage framework. This move directly addresses the leverage ratios that member firms can offer to their retail clients. While the European Securities and Markets Authority (ESMA) has established a set of regulations for this purpose, and although CySEC regulators must comply with European regulations, they also hope to introduce an additional layer of flexibility to encourage more retail trading.

CySEC has proposed a risk-based approach to measuring leverage for trading various financial instruments. Clients will first be assessed based on a set of criteria and then assigned to specific leverage tiers. These criteria include risk tolerance, experience, knowledge, historical market volatility, and their annual income or net worth.
The tiers are defined for different categories of retail clients; based on these tiers, they will be eligible for different leverage levels across various financial asset classes. Generally, these tiers will be designated as “eligible” or “ineligible.” There will also be clients who fall between these two categories and are classified as “gray.”
The last thing regulators want to do is offer the highest leverage terms to clients who are unsuitable for high-risk trading activities. Therefore, high-tier clients must have an annual income of at least 40,000 euros or a net worth of liquid assets exceeding 200,000 euros.Compared to the 30:1 ratio proposed by ESMA, high-tier clients will be able to access 50:1 leverage on major currency pairs. Under ESMA’s leverage directive, clients classified as “gray” will be limited to 20:1 leverage on the same major currency pairs.
Client categorization is clearly an area that Cypriot regulators will monitor closely, as they are aware that other European countries will be watching this pilot program closely; if the Cyprus Securities and Exchange Commission’s plan succeeds, other countries may follow suit.
CySEC has proposed further regulatory measures, such as phasing out all binary options trading and restricting trading in high-risk assets—such as cryptocurrencies—to only the highest-tier clients who are eligible to trade them.
How to Stay Ahead?
In addition to these initial measures, CySEC will require its member firms to comply with regulations such as closing positions when the margin ratio falls below 50% to prevent margin calls, as well as prohibiting all aggressive trading practices in financial markets. Mandatory risk warnings must be provided to clients, and firms must clearly disclose the percentages of clients who have made profits versus those who have incurred losses.
With all these new changes emerging, it appears that most brokers are seeking a reliable provider capable of addressing a wide range of compliance needs. A good option is to combine regulatory coverage with the broker’s other technical and peripheral requirements, such as company registration and payment gateway integration.
Forex regulatory requirements across Europe are constantly evolving, and Cyprus is no exception.
