The UK FCA license refers to the Financial Conduct Authority, which is the abbreviation for the UK’s Financial Conduct Authority.Established in 2013, the FCA is responsible for regulating investment financial institutions such as banks, insurance companies, and brokerage firms. Its establishment aims to enhance the public’s understanding of the financial system and the returns and risks associated with financial transactions, oversee the lawful operations of market participants, prevent and combat financial crime, and play a vital role in maintaining the normal, fair, healthy, and sustainable development of the investment market.
The UK’s FCA places emphasis on striking a reasonable balance between corporate restrictions and consumer rights, particularly the protection of investors’ interests, as reflected in the following three areas:
1. Investment firms licensed by the UK’s FCA must join the FSCS (Financial Services Compensation Scheme) if they offer retail services.This financial compensation scheme provides insurance coverage of up to £50,000 per investor. If the FCA determines that a broker is unable to repay its debts, the FSCS will initiate the compensation process to reimburse investors’ trading funds to the greatest extent possible;
2. Client investment funds held by financial institutions or companies regulated under an FCA license are deposited with a custodian bank. According to relevant regulations, if the custodian bank goes bankrupt, trading funds up to 85,000 pounds will be fully reimbursed;
3. Investors have the right to file a complaint with the Financial Ombudsman Service.
The scope of entities regulated by the UK’s FCA is quite broad, including but not limited to commercial banks, investment firms or financial advisors, the insurance industry, debt issuers, and futures trading firms. Additionally, the FCA’s margin requirements are among the highest among regulatory licenses.
Companies eligible to apply for FCA authorization include:
1. Financial institutions or companies based in the UK;
2. Financial institutions or companies conducting actual business operations in the UK;
3. Must employ qualified professionals and appoint company directors and shareholders;
4. Must pay the required security deposit and application fees;
5. Join the Financial Services Compensation Scheme: maximum compensation limit of £50,000;
6. Comply with relevant regulations, including anti-money laundering regulations, the Payment Services Regulations, and the Electronic Money Regulations.
Regulatory licenses issued by the UK’s FCA fall into four main categories: EEA Authorized, AR (Appointed Representative), payment licenses, and full licenses (Authorized).
1. FCA EU License: This type of license is the lowest tier among the four major categories. According to regulations, companies holding this license may provide financial services within the EU, but they are not subject to FCA supervision and therefore cannot benefit from the UK Financial Services Compensation Scheme (FSCS)
2.AR License: The key difference between this license and the EU license is that brokers holding this license are regulated by the FCA and are members of the FSCS. Companies with this license are not required to maintain an office in the UK.
3. Payment License: As the name implies, this license is issued to forex brokers that also operate payment services.
4. Full License: The highest-level license issued by the FCA, and the type most highly regarded by investors and reputable brokers.
Depending on the business model, this license can be further categorized into the following three types:
1) Investment Advisory License (IFPRU 50K License): Companies with this license may neither act as market makers nor hold investor funds, but investor funds are protected by the FSCS;
2) STP License (IFPRU 125K License): Companies with this license are not permitted to act as market makers, but they may hold client funds, which are protected by the FSCS;
3) MM License (IFPRU 730K License): These companies can act as market makers and hold client funds, which are protected by the FSCS; this is the highest-tier FCA license.
